1. About these terms
These terms apply to all landscaping and gardening work carried out by Casey Jones, trading as Casey Jones Landscaping ("Casey", "we", "us"), for you, the customer. They apply unless something different is agreed in writing, for example on your quote.
You can contact us on 07444 753470 or at casey.jones4114@gmail.com.
2. Estimates and quotes
Estimates are free and there is no obligation to go ahead. Your estimate is based on what can be seen and what you tell us at the visit, and is valid for 30 days unless it says otherwise.
Sometimes things only come to light once work starts, such as buried rubble, hidden roots, poor ground or concealed pipes. If this would change the price or the work, we will explain why and agree it with you before carrying on. No extra work will be charged without your agreement.
3. Booking and timings
Start dates and how long a job will take are our best estimate. Outdoor work depends on the weather and ground conditions, so dates sometimes move. We will keep you informed and rearrange as soon as we can if a visit has to change.
4. Your right to cancel
If you are a consumer and you agree the work with us at your home, by phone, by email or online, you normally have 14 days from the day the contract is agreed to cancel without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
If you want work to start within those 14 days, you need to ask us to do so. If you then cancel during the 14 days, you will pay for the work carried out up to the point you told us you were cancelling. To cancel, tell us clearly by phone on 07444 753470 or by email to casey.jones4114@gmail.com.
This right to cancel does not apply to business customers.
5. Payment
Unless your quote says otherwise, payment is due on completion of the work. For larger jobs we may ask for a deposit or stage payments, and this will be set out on your quote before you agree to go ahead.
For business customers, we may charge interest and compensation on late payments under the Late Payment of Commercial Debts (Interest) Act 1998.
6. Materials
Materials we supply remain our property until the job has been paid for in full. If you supply your own materials, such as slabs, bricks or plants, we will fit or plant them with care but cannot be responsible for their quality or for delays if they are late or not suitable.
7. Access and your property
Please make sure we can get into the work area on the agreed date, and tell us about anything we need to know, such as underground pipes, cables, drains, soakaways, septic tanks or anything fragile in or near the work area. We take reasonable care, but we cannot be responsible for damage to services that were not pointed out to us and could not reasonably have been found.
You are responsible for making sure the work is allowed, including confirming where your boundaries are and getting any permissions needed, such as planning permission, consent for protected trees, or agreement from neighbours for work on a shared boundary. We are happy to point out where we think permission may be needed.
8. Waste
Unless agreed otherwise, green waste and other waste from the job are cleared away and the area is left tidy.
9. Plants and turf
Plants, trees and turf are living things, and how well they establish depends on watering, weather and care after they are planted. You will be given aftercare advice. We cannot be responsible for plants or turf that fail because of a lack of watering, extreme weather, pests or disease, or damage after the work is finished.
10. Our standard of work and complaints
We will carry out all work with reasonable care and skill, as required by the Consumer Rights Act 2015. If you are not happy with any part of the work, please tell us as soon as possible and give us the chance to put it right. Nothing in these terms affects your statutory rights.
11. Liability
We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable, or for business losses where you are a consumer.
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.
12. Photos of our work
We may take photos of the work before, during and after the job to show on our website and social media. We never show house numbers, car registrations or anything that identifies you or your address. If you would rather your garden was not photographed, just tell us.
